Crespo vs. Crespo – the case that gave new hope to anyone who was ever hit with an unwarranted domestic violence restraining order – was overturned last June in a lower court decision that vacated a final restraining order (FRO) against defendant Anibal Crespo.
This case has now been granted an appeal at the New Jersey Supreme Court level, which will finally address the constitutional issues regarding domestic violence restraining orders. Many of these cases have been floating around the country. The Freeman case has been documented at WADVPress and a decision is due before the end of the year on that frivolous permanent restraining order request as well. At issue is a man’s job being denied via a security clearance due to the frivolity of that restraining order. He has lived away from his ex-wife in a different STATE for six years no, and she still wants a permanent restraining order without a basis in fact.
The utter ridiculousness of the Crespo case an be viewed here. At issue is a man being kicked out of his own house while not being any threat to the woman who is trying to accomplish this. At some point, the constitutional aspects of these laws being used as a weapon must be challenged. And, it is.
